Shane is a Senior Associate in the Restructuring and Special Situations team. Shane’s practice focuses on contentious insolvency, restructuring and commercial litigation. He has worked in both private practice and in-house roles within Australia and the United Kingdom.

He regularly acts for insolvency professionals, investment fund trustees, financiers, creditors, directors and financially distressed companies in a broad range of advisory, transactional and contentious matters, both pre and post formal insolvency appointments.  

Shane’s contentious experience includes acting for insolvency appointees in large-scale, complex asset recovery proceedings arising from major corporate collapses.

Representative experience

Acting for the Liquidators of MB Australia (formerly trading as Max Brenner) in a "mothership" proceeding against 12 defendants in respect of alleged voidable transactions totalling ~AU$10m.

Acting for the Liquidators of MB Australia (formerly trading as Max Brenner) in a ~AU$30m claim against its director and lenders for breach of duty and voidable transactions.

Acting for the Liquidator of Steller Developments in guarantee enforcement and rectification proceedings in respect of a AU$100m commercial loan note facility.

Acting for Ford US in respect of a suppression application in connection with discovery provided in a class action against Ford Australia.

Acting for the Liquidators of Hastie Group in a claim against over 30 major Australian construction companies for the recovery of AU$160m of called bank guarantee and outstanding payment claims*

Acting for the Liquidators of Hastie Group in a claim against the directors for beach of duty and the former auditors for negligence.*

Acting for an SPV investment company in an application restraining a Middle Eastern sovereign wealth fund from exercising rights in a joint venture concerning the €2bn Banco Santander headquarters.*

Acting for the administrators of the China Lesso Group in a dispute between sponsors regarding the validity of the administrators’ appointment.*

Acting for the Deed Administrators of FEA Plantations in a suite of recovery proceedings against investor 'growers' relating to unpaid fees and loan books.*

Acting for a £2bn family trading trust in extensive multi-jurisdictional litigation involving the UK SFO, former trustees, SPV liquidators and lenders, arising from the collapse of Kaupthing Bank.*

Acting for trustees in contested applications for directions concerning trust property in the Royal Court of Guernsey (ultimately appealed to the JCPC, now the leading authority on insolvent trusts)*
