Gemma is a Junior Associate in the Intellectual Property, Media and Technology practice of the Hogan Lovells Madrid office.
Her practice focuses on the defence and litigation of IP rights related to patents, trademarks, copyright, unfair competition, trade secrets and plant varieties. In particular, Gemma has been involved in complex multi-jurisdictional disputes in the Life Science (pharmaceutical and biotechnology), technology and telecommunications sectors before the Commercial Courts and the European Union Trademark Court, as well as in pre-litigation IP advice to a wide range of clients.
Representative experience
Advising multinational companies in the telecommunications sector, as well as their distributors, in the first litigation initiated in Spain on SEPs and FRAND agreements.
Advising a multinational company in relation to patent infringement proceedings concerning technological solutions for live advertising broadcasting.
Advising multinational companies (manufacture of mobile devices) on the filing of protection briefs in patent matters before the Commercial Courts of Barcelona during Mobile World Congress.
Advising one of the largest players in e-commerce and one of the most important car manufacturers in a trade mark infringement and unfair competition litigation (European Union Trademark Court).
Advising innovative laboratories in relation to patent and/or Supplementary Protection Certificates infringement proceedings (potential entry into the Spanish market of generic/biosimilar products).
Advising governmental institutions on the regulation and practice in Spain on plant varieties regarding fruits.
Advising a major furniture design company on the possible industrial design and copyright protection of its products.
