Marc Marinaccio focuses on complex civil litigation, commercial litigation and products liability, with particular emphasis on the life sciences industry. Marc handles all phases of high-stakes litigation, from formulating initial litigation strategy, to managing discovery and drafting motions, to trial preparation and post-trial appellate proceedings.

Marc also represents clients in arbitration and mediation, and is frequently called upon to help clients understand and manage their risks before litigation arises.

Marc has a deep understanding of the life sciences industry, including the regulatory systems that impact all phases of a client's development and operation, supply chain structures and common business relationships in the industry, and complicated pricing, marketing and reimbursement issues relating to government health care programs.

He has worked with a wide range of life sciences industry clients – from emerging biotech companies in the early stages of clinical development to some of the largest pharmaceutical and medical device manufacturers in the world. Marc's life sciences experience gives him a broader understanding of his clients' business goals and allows him to tailor his approach to achieve the best results for his clients.

Marc also maintains a healthy pro bono practice, representing refugees seeking asylum in immigration court, assisting low-income clients to expunge criminal records, and advising nonprofits that provide domestic violence support and healthcare services to vulnerable populations.

Representative experience

Represented a large pharmaceutical company in a federal class action and several state actions involving price reporting and reimbursement issues.
Successfully defended a small biotech company in a preliminary injunction proceeding involving allegations of trade secret misappropriation and tortious interference.
Represented numerous medical device and pharmaceutical manufacturers in federal and state court products liability actions.
Successfully defended small biotech companies in securities class actions relating to reporting of clinical trial results and adequacy of disclosures.
Represented a laboratory testing services company in a federal class action alleging violations of the Fair and Accurate Credit Transactions Act.
Represented large pharmaceutical manufacturers in qui tam actions involving purported anti-kickback violations.
Advised life sciences industry clients regarding potential commercial disputes under licensing, collaboration, distribution and supply agreements.
