Hans H. Hertell is a proven, decade-plus, first-rate litigation and arbitration partner, handling a variety of domestic and international business, intellectual property, media law and First Amendment disputes. Furthermore, Hans has been recognized as a leading attorney in sports, media and entertainment, with a dual focus in intellectual  property disputes and transactions.

His deal experience spans complex IP transactions, such as the acquisition and licensing of IP assets for clients ranging from a global hospitality brand, private university system, Grammy-winning musical artists and producers, and other leading voices in the creative industry. These clients also come to Hans for advice in managing and monetizing their IP rights, including valuable brands, with domestic and international trademark portfolios.

Hans’ practice is also international. Originally from Puerto Rico, Hans uses his multicultural and linguistic background to handle cross-border deals, disputes, and investigations, with a focus on Latin America, in energy, real estate, infrastructure, and other industries, and both for and against sovereign governments. He has conducted arbitration proceedings in foreign languages and under the auspices of leading arbitration centers, including the ICC, AAA/ICDR, ICSID, and JAMS.

Hans served as a Law Clerk with the U.S. District Court for the District of Puerto Rico, for the Honorable Judge Juan M. Pérez-Giménez. In addition, he completed an internship during law school with the U.S. Court of Appeals for the First Circuit, for the Honorable Judge Juan R. Torruella.

 

Representative experience

Advised live events company regarding a dispute with co-producer of a series of concerts for a renowned musical artist.

Secured favorable settlement for Univision and its news anchor, Jorge Ramos, of defamation claims filed in Florida State Court.

Issued successful takedowns of copyright and trademark infringing content under the DMCA and rights of publicity for IP owners, public figures and personalities.

Secured a successful resolution of ongoing disputes in international JAMS arbitration between a premium spirits brand and its U.S. importer.

Secured a successful resolution of labor and shareholder disputes between sugar trading company and former head trader.

Secured a favorable settlement of breach of contract claims for a blockchain technology company against an independent producer of television content for online streaming related to an NFT project.

Secured favorable settlement for plaintiffs in a complex $100m fraud case in Puerto Rico federal district court alleging violations of the RICO act/breach of fiduciary duties against defendants.

Successfully represented a Spanish language television company in a copyright infringement jury trial in Miami federal court awarding zero damages against a claim of $8m in damages.

Successfully represented a Spanish language radio company in a copyright infringement bench trial in a New York federal court awarding zero damage plus attorneys’ fees.

 

Advised musical artists and producers in various recording, production, and digital content monetization agreements. 

Advised songwriters/music producers in the sale of their music catalogue to a private-equity backed buyer and accompanying music production agreement for new music.

Advised global Michelin-star restaurant and hospitality group in management and brand license agreements across its U.S. and international portfolio. 

Advised a foreign spirit producer in sponsorship and endorsement deals with athletes, actors, and other talent, in connection with marketing, sporting/live events, and social media activity.

Advised a Florida manufacturing company in exclusive licensing agreement to manufacture small to medium electrical appliances for global consumer products brand. 

Advised on IP and trademark prosecution strategy and portfolio management for a global hospitality group, private university system, and other media and technology companies.
