Fernando focuses his practice on environmental compliance, litigation, and transactional due diligence.
Fernando provides compliance counseling and defends against government enforcement actions under the Clean Water Act, Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), Toxic Substances Control Act (TSCA), Resource Conservation and Recovery Act (RCRA), Clean Air Act, and state environmental statutes and regulations.
Fernando defends against cost recovery and contribution claims under Sections 107 and 113 of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). He has also litigated disputes relating to class action odor and nuisance allegations and pollution insurance coverage.
Fernando advises clients on environmental due diligence, provisions in purchase and financing agreements, and environmental insurance. He has worked on deals across a variety of industries and clients, including manufacturers, property developers, and private equity groups.
