Unearthed truth: lack of evidence from complainant means success for respondent

In a recent decision under the Uniform Domain Name Dispute Resolution Policy (UDRP) before WIPO, a panel has denied the transfer of the domain name ‘mytrueearth.com’, finding that the complainant failed to provide sufficient evidence to demonstrate that the respondent lacked rights or legitimate interests in the domain name and that the domain name was registered and used in bad faith.
