Ignoring well-established UDRP principles results in RDNH

ProjectPay Pty Ltd, the owner of various registrations for PROJECTPAY, sought the transfer of ‘projectpay.com’ under the UDRP. The panel noted that, when the respondent registered the domain name, the complainant was not yet established and had no rights in the trademark. The complainant knew, or should have known, at the time of filing the complaint that it was unable to prove one of the essential elements required by the UDRP.
