FERC gives power plant owners an opportunity to weigh-in on critical procedure governing compliance with MATS rule

On 30 January 2012, the Federal Energy Regulatory Commission (FERC) issued a notice of a commission staff white paper that outlines a process for FERC to advise the U.S. Environmental Protection Agency (EPA) on requests for extensions of time to comply with the EPA’s Mercury and Air Toxics Standards (MATS) rule. This is a critical opportunity for power plant owners to weigh-in on a process that will determine, in part, whether such facilities will have an additional year to comply with the wide-ranging requirements of MATS. Comments on the FERC process are due on 29 February 2012.
