Department of Labor Provides Guidance on New FLSA Provision Requiring Reasonable Break Time for Nursing Mothers

On 15 July 2010 the Department of Labor (DOL) issued a fact sheet providing guidance to employers regarding a recently-enacted requirement – a little-publicized provision of the health care reform law – that employers provide break time for nursing mothers to express breast milk. Following the law's enactment in March of this year, questions arose regarding its interpretation and practical application to employers. The guidance is meant to answer some of those questions. Although it does not have binding legal force, it provides employers assistance in understanding the requirements of the law and the DOL's intent.
