With almost four years having passed since the UK left the EU, in this year’s Brands Seminar we shall be looking at how the UK courts and the UKIPO are dealing with Brexit-driven changes to UK trade mark law and practice, and how the anticipated divergence between UK and EU trade mark law and practice is playing out, including in relation to:

  • bad faith and the ever-greening of trademarks (Sky v SkyKick and Lidl v Tesco);
  • honest concurrent use (Match v Muzmatch);
  • copyright and works of artistic craftsmanship (WaterRower v Liking);
  • Google "keywords" and internet advertising (E-Accounting Solutions v Global Infosys); and
  • an update on the UKIPO's practice post-Brexit.
