Contractor crunch time: Responding to OFCCP’s new initiatives on pay equity, compliance certification, audits, and more

The Hogan Lovells Employment and Government Contracts teams discussed significant developments for federal supply and service contractors, including from the Department of Labor's Office of Federal Contract Compliance Programs (OFCCP).

The discussion covered the following topics:

  • OFCCP's aggressive approach to evaluating pay equity, including its expressed intent to require contractors to turn over some privileged pay equity audits
  • The new portal contractors must use - by June 30 and annually thereafter - to certify affirmative action compliance
  • Reduced flexibility for contractors and increased discretion in OFCCP's audit and enforcement processes
  • The increased contractor minimum wage, "ban the box" for contractors, and the current status of the contractor vaccine mandate
