Diana Rodriguez advises international and national clients on all aspects of patent law and related other technical intellectual property rights. She represents them before German infringement courts as well as before the Unified Patent Court (UPC) in all areas of technology, including the coordination of parallel validity proceedings and cross-boarder cases. 

Her experience includes litigation in the fields of telecommunications, video and audio coding, software, acoustics, chemistry and household devices.

In particular in the field of batteries for electric vehicles, she has gained in-depth knowledge of the industry and market-specific legal issues. The same applies to the medical device industry, where Diana worked during a 10-month secondment in the in-house IP legal department of one of our clients handling all aspects of IP contracts, in particular R&D agreements, IP licensing and NDAs involving the technical departments and external research partners across Europe.  

She has a strong European and interdisciplinary focus, which makes it easy for her to work across different industries and areas of law. This is illustrated, for example, by the facts that Diana holds a Master's degree in "European Legal Linguistics" and that she spent her legal traineeship in our Düsseldorf Antitrust team, where she worked intensively on standard-essential patents and FRAND defense. 

Representative experience

Acting for manufacturer of household appliances in enforcing its patent rights before the UPC.

Representing manufacturer of hearing instruments in patent infringement proceedings relating to MEMS microphones, including coordination with parallel opposition and foreign infringement proceedings. 

Advising a manufacturer in developing a comprehensive pan-European strategy for enforcing its patents concerning battery cell chemistry, including the UPC.

Advising different global technology companies in licensing negotiations regarding standard-essential patents and FRAND obligations as well as patents in the field of speech recognition. 

Representing multinational IT security company in patent infringement cases relating to network security features and network management features.
