Helion Energy, a pioneer in nuclear fusion, continues to achieve several groundbreaking milestones to advance the commercialization of fusion energy.
These include securing the first-ever fusion power plant purchase agreement with Microsoft, developing a domestic licensing path for fusion, and applying for a prototype facility license. These projects involve a number of “first of a kind” contracting, business structures, and regulatory issues. And they raise a number of novel regulatory and policy issues.
Hogan Lovells' nuclear team has been instrumental in guiding Helion Energy through historic achievements in nuclear fusion.
In 2023, we facilitated the first-ever fusion power plant purchase agreement with Microsoft and supported the company in developing a domestic licensing path for fusion, that aligned with the regulator’s determination. Our ongoing support includes assisting Helion in licensing its next-generation prototype and shaping global discussions on fusion commercialization. In 2024, we advanced a new fusion licensing framework, inspired by the aviation industry, a concept that ended up in federal legislation directing the NRC to review this type of approach.
We also supported Helion's other negotiations for deploying fusion reactors. Our collaboration included engagement with the International Atomic Energy Agency, addressing licensing, manufacturing, and nonproliferation, and several thought-leadership papers.
