Ethereum’s move to proof-of-stake (“the Merge”) has triggered many reactions. Aside from the significant environmental implications, regulators across jurisdictions, including the US and within the EU have raised questions whether “staking” could be a form of investment that may turn tokens into securities. This is just one example of the legal implications that are attached to different types of blockchain consensus models. They also relate closely to transaction security, scalability and decentralization – to form a complex intersection between technical functionalities and legal implications of crypto assets.
