One Year into Germany's Newly Regulated Gambling Market: Status Quo and Outlook

On 01 July 2021, the new German State Treaty on Gambling (GlüStV 2021) entered into force. It marks a milestone: After years of legal uncertainty, the new State Treaty establishes a clear framework to open the German online gambling market.

One year into the new regulatory regime, the practical implementation has taken shape. The first operators of virtual slot machines have received their nationwide licenses. Enforcement is also being strengthened: The Joint Gambling Authority has adopted its competencies in this field, taking on market relevant tasks such as IP blocking and payment blocking.

With licensing and enforcement up and running, the first lessons on the newly regulated market can be drawn. Still, questions remain: What does the regulator plan for relatively ‘new forms’ of gambling, such as betting on esport events, daily fantasy sports, or potentially lootboxes? How will online roulette and other online table games be regulated? And which stakeholders will be relevant from 01 January 2023 on, when the Joint Gambling Authority will be responsible for overseeing the online markets for online sports betting and virtual slot machines alike?
