Webinar three: Monetary compensation vs. injunction in data class actions

During our final webinar in our Data Class Actions webinar series, our global team discussed the combination of regulatory inquiries and data class actions as well as compensation for damages under the General Data Protection Regulation (GDPR).

As the GDPR does not set out any criteria to assess recoverable damages, it is left to national laws to determine whether any damage may be compensatable.

Given the diversity across member states and the scope of the GDPR there is much to be considered. Our team notably discussed what this means in practice, how proceedings before data protection authority may impact the outcome of a class action, and how compensation may be sought.
