Virtual Seminar on The State of the European Union: The Judgment of the German Federal Constitutional Court on the European Central Bank's Public Sector Purchase Programme

We are pleased to invite you to a virtual seminar on 4 June 2020 to discuss the impact of the recent judgment of the German Federal Constitutional Court concerning the European Central Bank's Public Sector Purchase Programme on the European legal order and in particular the relationship between the Court of Justice of the European Union and the courts of EU Member States.

On 5 May 2020, the Constitutional Court held that the CJEU acted ultra vires. It found that it was not bound by the preliminary ruling of the CJEU on the PSPP, notwithstanding consistent CJEU decisions that its preliminary rulings are binding on the national courts of EU Member States, because the CJEU had failed to properly apply the proportionality principle.

Our panel of EU and constitutional law experts, moderated by London partner Dr. Markus Burgstaller, will discuss the judgment and its likely ramifications, in particular on the principle of EU law supremacy and financial assistance to address Covid-19. How will the institutions of the European Union respond to the judgment? Are infringement proceedings against Germany on the horizon?
