The war in Ukraine, inflation, supply chain issues, and multiple further larger and smaller global political, social and economic calamities are putting increasing pressure on European bond issuers, who are just emerging from the Covid-19 crisis. Many issuers and their bonds have already been affected in this regard and many will likely follow. Against this background, our combined team of German, Dutch and UK law experts for restructuring and capital markets matters Christine Borries, Dr. Olaf Gärtner, Dr. Julian Fischer, Dylan Goedegebuure and James Maltby will provide valuable insights in the latest developments, challenges, and opportunities in relation to national and cross-border bond restructurings. 

The panel discussion will involve various restructuring topics covering, among other things, legal and practical challenges involving consent solicitations pursuant to the German Bond Act (Schuldverschreibungsgesetz – SchVG). In addition, the session will provide a comparative overview of the features of various restructuring procedures available in the EU and in the UK such as the German StaRUG, the Dutch WHOA, or the UK Part 26A proceedings. Due to their significance in cross-border scenarios, the session will also focus on issues relating to COMI and the recognition of foreign proceedings. 

You will have the opportunity to engage in lively discussions and gain a greater overview of the above issues in the European market. This panel discussion is aimed at professionals from all industries seeking further insight from industry experts and experienced lawyers, and who are interested in meeting like-minded individuals.

As the other sessions of our HL Bond Restructuring Series, this panel discussion will take place in our scenic Frankfurt office (and alternatively also online – but we hope to welcome as many of you as possible in person). The language of the discussion will be English. Light refreshments and catering will be provided and there will be ample opportunity to network following the session.
