COVID-19: the impact on employment tribunal litigation in the UK

Even before COVID-19 struck, the employment tribunal system was handling increasing numbers of claims with limited resources, meaning cases were sometimes taking a long time to be heard. Then at the beginning of lockdown, the Presidents of the Employment Tribunals issued a Direction converting all in-person hearings due to take place between 23 March 2020 and 26 June 2020 into case management hearings. At the time of writing, hearings due to start after 26 June that have not already been postponed remain listed.

The Presidents published the outcome of their most recent review of the Direction on 1 June, along with a roadmap for increasing the number of employment tribunal hearings that will be able to take place over the coming months. In this webinar we will explain what the roadmap means for employers facing existing or new claims and discuss our experiences of how tribunal hearings and judicial mediations are currently operating in practice.
