Markus Kuczera is a patent litigator. He knows how to deal with patents and utility models so that his clients can do their business smoothly. Asserting and enforcing patents against infringers as well as developing defense strategies is part of this. Some call Markus "Mr Vascular" since he has in-depth experience in medical devices such as stents, coils, catheters and heart pumps. But, as a smart lawyer, he also has been playing in the arena of smart devices for many years. Markus speaks German, English, Latin – and the language of the courts. So he represents his clients before all relevant German courts dealing with patent matters.
This goes from district court level up to the Federal Supreme Court, but also brings him to the Federal Patent Court as well as the European Patent Office. Moreover, he is ready for the Unified Patent Court. And he also has broad experience in comprehensive arbitration under the WIPO Arbitration Rules which took him several times to New York. He also spent time there during a secondment and assisted in a patent trial before the S.D.N.Y. This helps him to explain to his clients the differences between the European and the U.S. patent system.
He studied at the University of Cologne, where he ultimately received a scientific doctor. His traineeship was in Dusseldorf with periods inter alia at the district court, Chamber for Commercial matters or at the District Government, Department of Health. Finally, he spent time at the German Federal Cartel Office. That is where he laid ground for his deep understanding of issues at the interface of IP and competition law.
