X-energy, selected by the U.S. Government to build a first-of-a-kind advanced reactor, faced the challenge of navigating complex regulatory and partnership landscapes to construct a reactor at a Dow chemical plant in Texas.
This project, part of a US$1 billion cost-share with Dow, aims to decarbonize industrial power and enhance U.S. geopolitical competitiveness. These projects are novel energy projects, raising “first of a kind” regulatory issues.
Hogan Lovells serves as nuclear regulatory counsel to X-energy, supporting their pivotal developments in advanced reactor technology, including the parentship with Dow to construct an X-energy reactor in Texas, a key step in industrial deployment of nuclear power. We also supported X-energy’s fuel fabrication facility, including advising on nuclear regulatory matters and supporting them in securing a $170M tax break under the Inflation Reduction Act for a first-of-its-kind fuel fabrication facility in Tennessee.
