David Taylor is a partner in the Intellectual Property, Media and Technology Group. David has a Masters of Engineering from Birmingham University, UK, and a PhD in Physics from the INPG, Grenoble, France and is admitted to practice law at the English and Paris Bars.
He specialises in Internet related intellectual property, and in particular the protection of brands online covering trade mark and copyright issues, keywords and domain names. He also advises on data protection and privacy, intermediary liability, encryption regulation and security issues, software licensing and development agreements.
David heads up a specialist International Internet Domain Name Practice at Hogan Lovells covering global strategy, new gTLD advice, centralised registration, recuperation and management of client portfolios in over 200 ccTLDs and all gTLDs.
David is a Domain Name Panelist for the UDRP with the World Intellectual Property Organization (WIPO) deciding domain name disputes between parties. He is also a panelist for UK domain name disputes with Nominet, an arbitrator for .EU and the UDRP with the Czech Arbitration Court, a domain name panelist for .FR with CMAP (Centre de Médiation et d'Arbitrage de Paris) and an arbitrator for the Malaysian domain name .MY.
David has significant experience in the domain name industry dating back to 1997. He has advised many clients on numerous launches of TLDs over the last decade, (e.g. .INFO, .BIZ, .EU, .MOBI, .ASIA, and .TEL) including sunrise periods, launch procedures and validation of rights. David and has been attending ICANN meetings since 2000 and is a member of the Intellectual Property Constituency (IPC), was a member of the Implementation Recommendation Team (IRT) set up by ICANN in March 2009 to propose and develop solutions to the issue of trademark protection in connection with the introduction of new gTLDs and currently is the IP representative for Europe on the ICANN GNSO Council and is a special advisor to the INTA Internet Committee.
David won the International Law Office (ILO) Client Choice Award in 2011 in the Information Technology category for France, and has been selected for inclusion in the 2011 Who's Who Legal Internet, E-Commerce & Data Protection category for France. The team was also recognised in 2011 by Managing Intellectual Property, winning the European Firm of the Year for Internet and Domain names.
REPRESENTATIVE EXPERIENCE
- Filing the first every fully electronic UDRP case for a large European Telecoms client with WIPO.
- Advising a number of international companies with regards to data protection issues on a pan European basis as well as transfer of data outside France and the European Union.
- Drafting and negotiating a series of software licence and development agreements and advising on the same across a number of EU countries.
- Providing strategic advice to numerous clients on new gTLDs applications, global online strategy, portfolio management and domain name enforcement globally.
- Providing advice to several banks and other companies on French encryption regulations.
- Negotiating the purchase of several high value domain names during 2011 amounting to over $4 million.
