On September 22, the U.S. Senate Commerce Committee’s Consumer Protection, Product Safety, and Insurance Subcommittee held a hearing on S.3742, The Data Security and Breach Notification Act of 2010.
This Act would give the Federal Trade Commission the authority to require a wide range of commercial and nonprofit entities to establish security practices to protect personal information, including social security numbers and certain financial information. Entities also would be required to notify individuals in the event of a breach of such information. Hogan Lovells US LLP partner Melissa Bianchi testified before the Subcommittee about the effect this legislation would have on HIPAA covered entities, on behalf of the American Hospital Association.
