EU-UK Spotlight: Renewables, trade, and the global supply chain
The claimant, Innsworth, who funded collective proceedings brought against Mastercard by Mr Walter Merricks, sought to challenge the Competition Appeal Tribunal’s decision as to the distribution of proceeds of a settlement agreed between Mr Merricks and Mastercard. The CAT’s decision provided that any settlement proceeds ringfenced for the class that are not ultimately taken up by class members would be redistributed by the Foundation.
The Foundation made submissions, which were accepted by the Divisional Court, that that aspect of the CAT’s judgment was lawful.
Any unclaimed funds that are received by the Foundation will be redistributed to advice organisations that support thousands of UK consumers every year.
The Hogan Lovells team was led by Christopher Hutton (partner), who was supported by Louis Biggs (senior associate), Georgia Crawford (associate) and Paul Sanderson (trainee). The Foundation instructed Gerard Rothschild at Brick Court Chambers as counsel, who also acted on a pro bono basis.
The judgment can be found here.
