As counsel in our insurance and reinsurance team Charlie Shute concentrates on advising clients on insurance and reinsurance disputes, including litigation, arbitration and Alternative Dispute Resolution. His clients include insurers, reinsurers, (re)insurance intermediaries and insured companies.
Charlie has experience in providing advice to clients on coverage and claims handling across multiple classes of insurance and reinsurance business (including property, product liability, energy and financial lines claims), and on complex disputes arising in the (re)insurance sector. He also advises clients in relation to regulatory matters including insurance distribution, the effect of economic and trade sanctions, the mis-sale of insurance products, and public law matters including issues arising from Government commissions of inquiry.
Prior to joining Hogan Lovells, Charlie was a solicitor in the Sydney office of one of Australia's leading insurance law firms.
Representative experience
Advising financial institutions on the mis-sale of Payment Protection Insurance, and acting in related litigation in the English Courts up to and including the Supreme Court
Acting for an insurer in a large claim against a coverholder for breach of duties in connection with a large book of liability business
Acting for reinsurers in arbitration proceedings relating to reinsurance claims made following the COVID-19 Pandemic
Representing AXA Versicherung in its Commercial Court claim for the avoidance of an energy construction treaty on grounds of material non-disclosure
Advising various reinsurers in disputes relating to complex Lloyd's reinsurance structures
Acting for a private equity investor in litigation arising from claims under a buy-side Warranty & Indemnity Insurance policy, valued at c.EUR75million
Providing advice to insurers, brokers and insured companies on the impact of economic and trade sanctions on (re)insurance business
Advising clients on the drafting and interpretation of (re)insurance policy wordings
Acting for insured companies in relation to cyber fraud claims
Acting for a Gibraltar-based motor insurer and its investors in High Court litigation relating to breaches of contract and misuse of trade secrets by a customer-facing intermediary
