Mark Brennan’s practice encompasses broadband technology and consumer protection, with a particular focus on global spectrum policy and mobile privacy. He represents clients before the Federal Communications Commission, Federal Trade Commission, and other federal and state agencies on a wide array of regulatory and transactional issues related to broadband deployment, mobile applications and location-based services, telemarketing, equipment development, and data security matters. He regularly advises clients in all segments of the wireless ecosystem, including service providers, network infrastructure suppliers, equipment manufacturers, and application developers, as well as a diverse set of international clients from the technology, transportation, financial services, education, and healthcare sectors.
Mark has experience across a broad range of wireless services, including cellular, PCS, AWS, 700 MHz, BRS/EBS, WCS, 220 MHz, telematics, mobile satellite service, medical telemetry, public safety, private land mobile, unlicensed, and experimental communications. He counsels clients on a variety of communications issues, including FCC auctions, broadband deployment, equipment authorization, harmful interference, spectrum leasing, E911, and the Communications Assistance for Law Enforcement Act (CALEA).
Mark also advises clients on consumer protection matters related to privacy and data security law, including Section 5 of the Federal Trade Commission Act, the Telephone Consumer Protection Act, the FCC’s Customer Proprietary Network Information (CPNI) rules, the Video Privacy Protection Act, the Children's Online Privacy Protection Act (COPPA), state data breach statutes, and other relevant law. He also regularly counsels clients on issues related to mobile marketing, location-based services, and online behavioral advertising.
In addition to his regulatory practice, Mark advises clients on a variety of commercial agreements, including asset purchases and leases, content licensing, and network access arrangements.
Mark is currently the Co-Chair of the Federal Communications Bar Association’s Young Lawyers Committee and a past Co-Chair of the organization’s Transactional Practice Committee.
Prior to joining Hogan Lovells, Mark was an associate at another Washington, D.C. firm, where his practice included telecommunications, civil litigation, and environmental law matters. He has also interned at the FCC in the office of former Chairman Michael Powell.
