Deen Kaplan, a Director of the firm's international trade and investment group, represents businesses and governments in a wide range of international trade and investment disputes, policy matters and customs/security-related issues. Deen acts on behalf of clients in several fora, including dispute settlement proceedings before the World Trade Organization (WTO), the London Court of International Arbitration (LCIA), U.S. and Chinese government-led investigations and appeals, NAFTA disputes and trade-related bilateral and multilateral negotiations. Deen's areas of concentration include international arbitration, government-related disputes, subsidy law policy, WTO matters, countervailing and antidumping duty litigation, security and trade, and trade in technology products.
Deen also brings to bear nearly a decade's worth of practical experience in the business and nonprofit sectors, including service as an executive in computer hardware, software development, and consulting businesses.
Deen is the associate editor of the Kluwer Law International ITA Monthly Report, an international arbitration law journal published in association with the Institute for Transnational Arbitration. He also lectures regularly on international trade and investment issues and teaches international trade and dispute law at the University of Maryland School of Law as a member of the adjunct faculty. The 2007 edition of Chambers USA lauds Deen as "unbelievably smart," noting his role in one of the world's largest trade disputes and his capacity to "blow clients away" with his work.
REPRESENTATIVE EXPERIENCE
Represent the Government of Ontario, Canada in multiple LCIA international arbitrations arising under the Softwood Lumber Agreement between Canada and the United States. Represented the Government of Ontario in the world's largest countervailing duty dispute, Softwood Lumber from Canada, which included multiple proceedings before U.S. administrative agencies, concurrent litigation before NAFTA appellate panels, and counsel for related WTO proceedings. Provide policy counsel regarding Canada-U.S. lumber trade.
Represented the Ministry of Commerce of the Government of China in the U.S. subsidy and antidumping investigations of Off-the-Road Tires and Oil Country Tubular Goods from China.
Represent the Ford Motor Company in the Chinese countervailing duty and antidumping investigations of automobiles from the United States.
Prepared a detailed public report addressing the legal and policy implications of government subsidies received by a major multinational industry.
Represented a principal government party before a World Trade Organization dispute settlement panel in WTO DS362.
Successfully assisted a government and several companies in achieving a major WTO decision rejecting the practice of imposing countervailing duties on unsubsidized private companies. The practice was subsequently revoked, and the applicable duties for our clients were substantially reduced.
Successfully represented clients in U.S. trade remedy proceedings involving stainless steel products from various countries. Our client's trade remedies liability was significantly reduced through effective advocacy in several administrative and appellate fora.
