Peter Whitfield

Peter Whitfield assists companies with environmental issues during project development and operation. With significant trial experience, Peter helps companies navigate citizen suits, enforcement actions, and challenges to their environmental clearances.

Peter litigated complex environmental cases in his role as a trial attorney in the U.S. Department of Justice's Natural Resources Section as well as in private practice, addressing issues under the Clean Air Act, National Environmental Policy Act (NEPA), Migratory Bird Treaty Act (MBTA), Endangered Species Act (ESA), National Historic Preservation Act (NHPA), and numerous others. Through this experience, Peter has helped companies in the steel, energy, natural resource, and agricultural industries.

Representative experience

Defended steel manufacturer in state and federal challenges to its Clean Air Act permit.*

Defended silicon metal company in a Clean Air Act citizen suit.*

Represented offshore wind company in litigation involving issues under NEPA, ESA, MBTA, NHPA, and Outer Continental Shelf Lands Act.
