USCIS reaches the H-1B Cap

This Alert provides an important update on the H-1B visa caps. The U.S. Citizenship and Immigration Services (USCIS) announced that, as of 11 June 2012, a sufficient number of H-1B petitions were filed to reach the statutory cap of 65,000 for fiscal year (FY) 2013 (the “H-1B Regular Cap”). Monday, 11 June 2012, was the final receipt date for new H-1B specialty occupation petitions requesting an employment start date in FY 2013. In addition, as of 7 June 2012, USCIS had received a sufficient number of petitions to exceed the additional 20,000 visas allocated solely to foreign workers who have obtained a master’s degree or higher from a U.S. institution of higher learning (the “H-1B Master’s Cap”).
