Trade Mark Battles
In April 2007 the European Court of Justice delivered a judgment concerning the circumstances in which trade mark owners may rely on their trade mark rights to prevent the repackaging of their parallel traded products. The judgment refers, in particular, to overstickered or reboxed products. Elisabethann Wright and Susan Jane Clements review the implications.
