The New ICC Rules: Revolution or Evolution?

This article describes the changes wrought to ICC arbitration by the 2012 Edition of the ICC Rules of Arbitration, which will take effect on 1 January 2012. The authors also provide a tabular comparison of the salient provisions of the 1998 and 2012 editions of the Rules.

After a long process initiated in 2008, led by a Task Force made up of 175 arbitration professionals and users from 41 different countries, the International Chamber of Commerce (ICC) launched a revised edition of its Rules of Arbitration at a conference in Paris on 12 September 2011. The 2012 Edition of the Rules (the 2012 Rules or the Rules)) updates the version in force since 1 January 1998 (the 1998 Rules). The 2012 Rules will enter into force on 1 January 2012.
