The Creation of a Competition Authority with a Wider Scope of Activity

The bill for the Modernization of the Economy, adopted by the French National Assembly on June 17, 2008, contains an important section creating a Competition Authority with a wider scope of activity. The organization and the scope of activity of this authority is defined in a regulation that aims to make the enforcement of national competition law clearer and more efficient. Apart from its institutional aspects, the reform is based on two main strategies: (i) the unification under the aegis of the Authority of all functions of enquiry and investigation related to anti-competitive behaviour; and (ii) the near-monopoly imparted to the Authority with regard to merger control.
