Punitive damages in France

Ruling for the first time on this issue, the French Supreme Court held on 1st December 2010 that an order to pay punitive damages is not, in itself, contrary to French international public policy.  The French Supreme Court also upheld the non-recognition of the foreign judgment in France on the ground that the amount allocated to the claimant was disproportionate given the loss suffered and the debtor's breaches of its contractual obligations.
