Private Antitrust Damages in Europe: As the Policy Debate Rages, What are the Signs of Practical Progress?

In December 2005, the European Commission published a Green Paper exploring alleged obstacles to the bringing of successful private actions for damages in antitrust cases in Europe and setting out a series of options for addressing these obstacles. Following a consultation period, during which the Commission received more than 140 responses, it is now drafting a White Paper, which will set out concrete proposals to further its inititiative.
