Following the recent implementation of the EU e-Privacy Directive, the Italian Data Protection Authority (the "Garante") has issued a set of guidelines based upon which telecom operators and access providers are required to notify the Garante and data subjects of data breaches.
The guidelines clarify who is subject to the notification requirements, circumstances under which notification requirements are triggered vis-à-vis data subjects, the organizational and technical security measures that need to be implemented in order to notify the Garante and data subjects of a personal data breach, and the format and modalities of the notification.
