Liability for Nuclear Incidents: Should the UK Now Follow the U.S. Approach?

The UK civil nuclear industry is changing rapidly. Recent developments include:

1. the creation of a new regulatory body, the Nuclear Decommissioning Authority (NDA), pursuant to the Energy Act 2004 with responsibility for all existing civil nuclear facilities,

2. proposals to commence a nuclear decommissioning programme at an approximate cost of £70-90 billion and

3. proposals for the letting of major contracts on an open, competitive basis to the private sector for the decommissioning and clean-up operations.
