Hogan Lovells Newsflash: Washington State introduces new IT Unfair Competition law

12 December 2011

Effective from 22nd of July this year, the new law passed in the State of Washington, U.S.A. is designed to give a boost to preventing unfair competition by manufacturers who use stolen or misappropriated Information Technology ("Illegal IT") to the detriment of manufacturers using legally acquired IT. The law has more far reaching effects, with persons involved in the supply chain downstream from the manufacturer also facing new liabilities if they failed to take commercially reasonable steps to prevent the use of stolen or misappropriated IT.
