FTC Advisory Opinion Approves Drug Shortage Initiative

On August 8 2012 the Federal Trade Commission (FTC) issued an advisory letter which concluded that an initiative proposed by the Generic Pharmaceutical Association to address drug shortages is unlikely to harm competition. The advisory opinion was issued in response to the association's request for review of its proposed accelerated recovery initiative, pursuant to which manufacturers of generic drugs in short supply will compile competitively sensitive information and provide it to the US Food and Drug Administration (FDA) in order to help the FDA to address drug shortages.
