EPA to initiate proposed rulemaking for hydraulic fracturing fluids

Environmental Alert

On November 24, 2011, the Environmental Protection Agency (EPA) agreed to partially grant the requests made in an August 2011 petition by Earthjustice and 114 other environmental groups to gather data under the Toxic Substances Control Act (TSCA) regarding fluids and chemicals used in hydraulic fracturing. Specifically, EPA has agreed to propose rules pursuant to Sections 8(a) and 8(d) of TSCA for the chemicals substances and mixtures used in hydraulic fracking.
