D.C. Circuit calls 2015 FCC TCPA autodialer decision “utterly unreasonable”; Strikes down reassigned numbers framework

Recently, the D.C. Circuit Court of Appeals issued its decision in ACA International, et al. v. FCC, a case pending before the court for nearly two years that has significant implications for anyone that uses a telephone to engage with customers or clients. The court resolved four issues in response to multiple petitions for review of the Federal Communications Commission's (FCC's) omnibus 2015 ruling interpreting provisions of the Telephone Consumer Protection Act (the TCPA or Act). The court reversed some of the FCC’s rules and upheld others. Below we provide the bottom line and our expectations for next steps.
