Court rejects application to medical devices of the right to disclosure under German Medicinal Products Act

As in most jurisdictions, in Germany the law differentiates between medical devices and medicinal products. These are primarily regulated, respectively, by the Medical Devices Act 2002 (Medizinproduktegesetz) and the Medicinal Products Act 1976 (Arzneimittelgesetz)

(MPA). In this regard, s 84a of the MPA gives claimants the right, as an exception to the general law to the disclosure of information from pharmaceutical companies.
