CAN-SPAM Discretionary Rule Released

Three years to the day after it first released a notice of proposed rulemaking relating to discretionary rulemaking under the CAN-SPAM Act, the Federal Trade Commission released its final rule and commentary related to the proposed discretionary rules. Generally, the final rule provides clear guidance to companies that send commercial e-mails, and helps clarify certain complicated fact patterns in e-mail marketing.
