Philip Van Rensburg

Philip van Rensburg focuses on construction and engineering law with emphasis on commercial litigation. He advises clients within the construction, engineering and mining industries, as well as in the energy and chemical sectors. In addition, he provides advice on projects in all these industries and sectors.

He represents and advises local and international mining, construction and engineering companies in dispute resolution proceedings, including civil litigation, arbitration under local and international rules (ICC), and adjudication (DAB) proceedings in local and international disputes.

Philip advises contractors, engineers and plant owners in both contentious and non-contentious matters on all aspects arising from FIDIC, GCC, JBCC and NEC3 contracts. 

Philip has been recognised by Legal 500 EMEA as one of South Africa's leading lawyers for contentious construction work.

He has extensive experience in drafting EPC and EPCM contracts in the construction, energy, infrastructure, mining and telecommunications industries, as well as identifying, evaluating, formulating and defending claims in relation to construction and engineering projects.

Philip’s other practice areas include class action litigation, business recovery, insolvency and restructuring and securities litigation. 

He is a regular speaker at construction law seminars and workshops.

Representative Experience

Representing a contractor on the Gautrain project with claims for time extension for completion and payment of additional costs of ZAR60m in DAB proceedings.

Advising on claims for time extensions and additional costs in excess of ZAR1bn in DAB proceedings under the FIDIC Yellow Book contract for engineering design.

Advising a contractor on various contractual disputes for the development and construction of a process plant in the Democratic Republic of Congo.

Representing a contractor with claims arising from the construction of a fibre optic network in arbitration proceedings in accordance with the FIDIC Silver Book contract.

Advising an employer on the development and construction of an elution plant in South Africa.

Advising a contractor on the development and construction of a demineralised water treatment plant in the Democratic Republic of Congo.

Advising sponsors on EPC requirements for their bid in respect of the development and construction of a coal-fired power project.

Representing a chemical manufacturer in a dispute regarding performance arising from a contract for service in Burkina Faso and Ghana.
