Protocol to the UPC Agreement signed by member states

On 1st October 2015, representatives of member states signed a “Protocol to the Agreement on a Unified Patent Court on provisional application”.

On 1st October 2015, representatives of member states signed a “Protocol to the Agreement on a Unified Patent Court on provisional application” (a full copy of the document can be found here ). 
 
In its announcement (here ), the Preparatory Committee explained that the purpose of the Protocol is to allow some parts of the UPC Agreement to be applied early (i.e. to be treated as if the system was already in place), to enable final preparations for the Court to be made (such as recruitment of judges, renting of rooms and testing IT systems).  The provisional application phase will also be used to allow for early registration of opt-out demands.
 
In its statement the Preparatory Committee also indicated that it aims to complete its work by June 2016 with a view to the Court opening at the start of 2017.
