Hogan Lovells obtains a major success for EDF before the European Court of Justice

The Grand Chamber of the European Court of Justice has confirmed this morning the judgment delivered by the European Union Court on the 15 December 2009 which had quashed, for error of law, a European Commission decision regarding State aid, which was unfavourable to EDF.
EDF, as well as two of its subsidiaries, RTE and ErDF, can thus keep the record amount of more than 1.3 billion euros which initially had to be reimbursed to the French state in 2004 and was returned to them following the decision in 2009.
