Hogan Lovells advises the senior lenders and tax investors on an award-winning Aircraft Finance Insurance Consortium (AFIC) deal
Hogan Lovells advised Société Générale Corporate and Investment Banking, Ingepar (a subsidiary of BPCE), Agence Française de Développement, Crédit Industriel et Commercial and several other financial institutions as senior lenders and tax investors on a complex AFIC-supported French Overseas LODEOM Tax Leases of two 787-9s for Air Tahiti Nui. This is the first AFIC supported deal of this kind and it has been recognised as the Asia Pacific Supported Finance Deal of the Year at the Airline Economics Aviation 100 Asia Pacific Awards in Hong Kong on November 5 2019.
The deal involved complex initial structuring and intercreditor issues with the finance documents governed by English and French laws to address the specific requirements in the context of a AFIC-supported financing and requirements of the tax investors and the French tax authorities in respect of LODEOM financings. It also involved negotiations with the government of French Polynesia.
