Who's got the privilege now? Legal professional privilege: Hong Kong updates

At the end of June, the Hong Kong Court of Appeal handed down a landmark judgment, redefining the general understanding of who constitutes a "client" for the purpose of legal advice privilege.

This is the latest in a line of recent Hong Kong judgments emphasising the primacy of legal professional privilege as an absolute right guaranteed by Article 35 of the Basic Law of Hong Kong.

However, while the doctrine of legal professional privilege is still absolute in Hong Kong, one must take care with one's privileged information to ensure that it remains so.
