Washington Metropolitan Area Corporate Counsel Association (WMACCA) Government Contractors Forum: Commercial Item Government Contracting - To Be (Commercial), Or Not To Be (Commercial), That Is the Question

Presented by David Drabkin, Director, Acquisition Policy, Northrop Grumman Corporation (Previously, Deputy Associate Administrator for Acquisition Policy at GSA) and Michael Mason of Hogan Lovells US LLP. Moderated by Tony Fuller, Chair, Government Contractor Advisory Services, Baker Tilly.This panel will address the top compliance risks faced by companies that sell commercial items to the federal government. The panelists will analyze current trends in commercial item contracting and focus on the highest risk areas, including: DoD’s recent push to narrow the FAR definition of Commercial Item; GSA Federal Supply Schedule Commercial Sales Practices disclosures and Price Reductions clause risks; current areas of government audit focus; and risks unique to commercially priced hourly labor services. The program will include practical advice and best practices to help corporate counsel mitigate commercial item contracting risk.
