Roundtable discussion on European measures for Online Copyright Enforcement - Lessons for Hong Kong

After years of deliberation, the HKSAR government has finally introduced the Copyright Amendment Bill 2011 to address copyright protection in the digital environment. A draft Code of Practice for Service Providers was issued on 22 July 2011 suggesting notice-and-notice and notice-and-takedown measures. Are these efforts sufficient and/or in synch with international developments? Is this too little too late? In 2010 France introduced three strikes legislation to combat online piracy and other European Union countries have looked at or introduced measures to combat internet piracy. What can Hong Kong still learn from such overseas experience?

About the speaker:
Zuzana Hecko spent three years as legal advisor at the European Commission where she dealt with civil enforcement of intellectual property rights, including enforcement of intellectual property rights such as ISP liability, electronic commerce, customs enforcement and privacy issues related to online copyright enforcement. Most recently she was involved in the preparation of preliminary ruling cases to the Court of Justice of the European Union and has helped draft the Memorandum of Understanding on the Sale of Counterfeit Goods over the Internet signed on 4 May 2011. Zuzana is spending a brief period of time as an intern at the Hong Kong office of Hogan Lovells and will be sharing her views and experience of online copyright enforcement in Europe with us and also offer some critical views and analysis of the Bill and the draft Code of Practice.
