European Patent Litigation: an overview

Hogan Lovells in partnership with the Association of Corporate Counsel Europe (ACC Europe) brings you the fifth in our complimentary webinar series focusing on the latest legal issues for in-house counsel in Europe.


Litigating patents in Europe today can be a complex affair involving national litigation in multiple European jurisdictions. To optimize Europe-wide patent litigation, it is essential to have a solid enforcement strategy.

Focusing on three key jurisdictions (Germany, UK and France), this webinar will provide a practical overview of strategies for enforcement and for dealing with patent litigation, notably:

  • Pre-litigation: what steps generally precede a decision to litigate, and will the choice of forum have an effect on initial steps?
  • Timing: how long can litigation last in these countries? Is it possible to obtain preliminary injunctions?
  • Outcome of the litigation: what damages and other remedies?
  • Cost
  • Interaction between the national courts: Exchange of information? Stay of proceedings? Precedents?
